RADAR SISCOMEX is a system administered by the Federal Revenue Service, whose purpose is to automatically monitor all the information on customs operations in Brazil.

This system/platform integrates the entire register of activities of companies that export to and import from the country, allowing trade management bodies to control these processes as well.

RADAR is the first step for anyone wishing to export. A company that doesn't have radar is unable to apply for an import/export license - which is generated on the Siscomex platform.

How to apply?

The first step in applying for RADAR is through the Portal HabilitaFor this you will need your digital certificate/ eCPF, or if you prefer you can go in person to a Internal Revenue Service fill out the application, so the applicant will receive all the information there - however, if you already want to learn about the subject, it is worth checking out the manual customs clearance, made available by the IRS.

Your company can be licensed in as little as 10 days thanks to Normative Instruction 1,984 of 2020, where the license process has been revamped to make it quicker and easier for applicants.

The application process can be done by the entrepreneur himself, but due to the bureaucracy many choose to hire logistics operators or customs brokers, who are professionals specializing in this process.

The good news is that the application to the Receita Federal is free, but if you choose to hire a broker or operator to intermediate the registration, you can prepare to spend a little.

Although there is no cost for registering with RADAR, there is an import cost known as the DI or Import Declaration.

After the date of application, the registration is valid for 12 months, so after this period a renewal must be requested on the portal itself.

Available categories

Therefore, in order to meet the needs of different types of entrepreneurs and business models, a number of registration categories have been defined:

  • Radar ExpressFor companies, it is unlimited for exports and has a defined limit of $50,000.00 / semester for imports.
  • MEIThere is no defined limit for exports, for imports there is a defined limit of $50,000.00 per semester.
  • Limited RadarFor companies, it is unlimited for exports and has a defined import limit of $150,000.00 per semester.
  • Unlimited RadarFor companies wishing to import more than R$150,000.00 per semester, you have the advantage of unlimited export and import.

Individuals are no longer required to have a license to operate, as long as it is really for their own use, otherwise it is advisable to open an MEI so as not to constitute fraud under customs rules.

Important

For MEIs, it is important to pay attention to the amount of turnover, which cannot exceed the annual limit of R$ 81,000.00.

The categories within the RADAR SISCOMEX platform exist to maintain control over operations. Otherwise, your activity may be canceled.

What documents are needed?

The documentation required to carry out the process depends on the category of registration, but in general the documents that must be up to date and available are:

  • Articles of association and other amendments;
  • Articles of association and latest amendments;
  • Simplified Certificate from the Board of Trade;
  • Copy of the ID and CPF of the managing partner;
  • Commercial Registry Certificate;
  • Certified copy of the CPF and ID of the legal guardian;
  • Negative certificate of debts (referring to federal taxes/union active debt and labor debts).
  • Simplified Certificate from the Board of Trade (Ficha cadastral simplificada);
  • Proof of DTE (Electronic Tax Domicile) - obtained through E-CAC with the E-CNPJ digital certificate;
  • Proof of payment of capital;
  • SODEA - Application Form Digital Service Dossier with a notarized signature according to the IRS model;
  • Application for Qualification with notarized signature according to the Receita Federal model;
  • A notarized Term of Responsibility according to the Receita Federal model;

  • The operating license;
  • Last year's IPTU;
  • The lease agreement for the company's property;
  • A copy of the electricity or telephone bill with the company's name and address.

In addition to the list of documents, there are other points that deserve attention during the process:

  • The company's legal representative must be included in the company's articles of association, and their CPF must be valid in E-CPF;
  • During the process, the tax auditor may request additional documents;
  • RADAR registration is linked to the CPF of the person in charge of the company. If the company is sold, a new registration must be applied for.
