The sports betting market in Brazil is booming, and tax regulations have kept pace with this evolution. On March 18, 2024, the municipality of São Paulo has taken an important step by publishing the Normative Opinion SF no. 1/2024, which establishes the basis for calculating Service Tax (ISS) for this sector. The measure aims to attract specialized companies and create a safer and more transparent business environment.

Details of the ISS calculation basis

According to the new opinion, the basis for calculating ISS in São Paulo for fixed-odds lotteries is part of the total amount collected (turnover), from which the prizes actually paid out to the bettors are subtracted, resulting in the GGR (Gross Gaming Revenue).

Next, the percentage of 12% earmarked under Law No. 13,756/2018 is deducted, arriving at NGR (Net Gaming Revenue)which will effectively serve as the basis for calculating the tax.

Therefore, the only deductions taken into account are:

  1. The prizes paid out to the winners.
  2. The percentage of 12% of the proceeds of the fixed-odds lottery (according to the provisions of § 1-A of art. 30 of Law no. 13.756/2018).

This calculation structure was created to attract sports betting companies to the municipality of São Paulo by offering clear rules and defining a stable tax burden.

Legal certainty is essential in this market, as it simplifies the understanding of tax obligations and reduces risks for those wishing to operate in São Paulo. It can be seen that income tax levied on the premium is no longer part of the deductions applicable to the calculation of ISS.

Legal context and reasons for regulation

Law No. 13.756/2018, amended by Law No. 14.790/2023, paved the way for companies authorized by the Ministry of Finance to operate "fixed odds" betting on sporting events and online games. This legal framework was fundamental to organizing a market that had been growing rapidly in Brazil, by providing a basic operating and inspection structure.

At the municipal level, SF Normative Opinion No. 1/2024 comes to complement this legislation, defining clear guidelines on how ISS will be levied on sports betting activities in the city of São Paulo. Already in force, the opinion has binding effect for all units and collegiate bodies of the São Paulo Municipal Finance Department, which guarantees a standardized application of the rules and avoids divergent interpretations on the form of taxation.

Impact on companies and the municipality's strategy

The regulation of the ISS tax base in São Paulo brings immediate benefits to companies in the sports betting sector. With well-defined tax rules, these companies can plan their investments and operations with greater security and predictability. In addition, clarity in tax obligations helps attract new companies - both domestic and foreign - looking for a more stable business environment.

São Paulo City Hall's initiative demonstrates its commitment to strengthening the local business environment and transforming the city into a strategic hub for the sports betting market. Faced with a segment that generates billions of reais annually and continues to expand, offering legal certainty and a transparent tax environment has been a key factor in attracting new investments and further boosting the growth of this sector.
