A Law 14.973The new law, enacted on September 16, 2024, brought significant changes to the Informative Register of Unpaid Credits of the Federal Public Sector, better known as CADIN. This register, which was already an important tool for the government to monitor the debts of individuals and companies, has had its scope expanded with the aim of making default management even more efficient.

Below, we explain the main changes to the law in a simple and straightforward way, so that you understand how they can impact your financial life.

What is CADIN?

Before we dive into the changes brought about by the new law, it is important to remember what the CADIN. This register gathers information on individuals and companies that have debts with agencies and entities of the Federal Public Administration. Being registered on CADIN can lead to various impediments, such as the impossibility of entering into government contracts or obtaining financing from public institutions.

CADIN acts as a kind of "list of debtors" for the federal government, contributing to transparency and fiscal control. With the recent changes, it has become even more comprehensive, helping public entities to monitor a wider range of debtors.

Main changes brought about by Law 14.973/2024

The new law brought innovations in relation to CADIN, expanding who can be included in the register and reducing the notification deadlines. We'll explore these changes in more detail below:

1. Broadening the scope of CADIN

With the new law, CADIN now covers a larger number of debtors. In addition to the individuals and companies that were previously listed, those who:

  • Have debts with states, the Federal District and municipalitiesThrough agreements with the Federal Government, these federal entities will be able to register their debtors with CADIN, which makes debt monitoring more comprehensive.
  • They are owed to professional bodies and professional councilsDebts with bodies such as the OAB, CREA and CRM, for example, are now subject to inclusion on the register.
  • Have irregularities with the FGTSCompanies that do not regularize their employees' situation with the Severance Indemnity Fund can also be registered with CADIN, which reinforces the protection of labor rights.

These new categories of debtors significantly increase the scope of the register, allowing the state and municipal spheres to also use CADIN as a tool for controlling defaults.

2. Reduced deadline for inclusion

Another important change brought about by Law No. 14,973/2024 is the reduction in the time limit for a debtor to be registered with CADIN after notification. Previously, the deadline was 75 days after notification, giving the debtor more time to regularize the situation. This deadline has now been reduced to 30 days.

This means that after being notified of a debt, the debtor only has 30 days to settle the debt or present a defense before being included in CADIN. This change aims to speed up the collection process, putting pressure on debtors to resolve their debts more quickly.

3. Provision of relevant information

Inclusion in CADIN must be accompanied by the provision of all relevant information about the debt. This transparency allows the debtor to be aware of all the details of the debt, which facilitates both payment and contestation if there are errors or irregularities in the registration.

Impacts for individuals and companies

The changes to CADIN brought about by Law 14.973/2024 have a direct impact on individuals and companies. For companies in particular, being up to date with labor and tax debts has become even more essential, since inclusion in CADIN can hinder access to financing, public contracts and other important business operations.

In addition, the reduction in the deadline for registration on the register requires greater attention to financial management, as the window of time for resolving outstanding issues has been significantly reduced. For companies, this control is even more critical, since a CADIN registration can directly affect their reputation and ability to do business.
